  2. The personal data of the Buyer and Service User are processed in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 883, as amended) and the Act on Providing Services by Electronic Means of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended).
  3. The Administrator exercises particular diligence to protect the interests of the data subjects and, in particular, ensures that the data collected by him are processed in accordance with the law; collected for specified, lawful purposes and not subjected to further processing inconsistent with those purposes; factually correct and adequate in relation to the purposes for which they are processed, and stored in a form that permits identification of the data subjects for no longer than is necessary to achieve the purpose of processing.
  4. All words or phrases written with a capital letter in the content of this Privacy Policy shall be understood in accordance with their definition contained in the Online Store Regulations.

II. PURPOSE AND SCOPE OF DATA COLLECTION

  1. The personal data of Buyers and Service Users, collected by the Administrator, are used for accounting purposes, marketing purposes, contacting the Customer, and other activities related to the performance of the Sales Agreement.
  2. The Administrator processes the following personal data of Service Users:
    • First and last name, company name,
    • Address (street and house/apartment number, postal code, city),
    • Phone number,
    • Tax Identification Number,
    • Email address.
  3. The Administrator may process the following data characterizing the Service User’s use of services provided electronically (operational data):
    • Identifiers of the telecommunications network termination or ICT system used by the Service User.
    • Information on the start, end, and scope of each use by the Service User of the service
      provided electronically.
    • Information on the Service User’s use of services provided electronically.
  4. The provision of personal data referred to in paragraph 2 is necessary for the Service Provider to provide services electronically within the Online Store or to conclude a Product Sales Agreement.

III. PRIVACY POLICY – BASIS FOR DATA PROCESSING

  1. The use of the Online Store, the conclusion of agreements for the provision of electronic services via the Online Store, or the conclusion of Product Sales Agreements, which entails the necessity of providing personal data, is entirely voluntary. The data subject independently decides whether they wish to start using services provided electronically by the Service Provider or conclude a Product Sales Agreement in accordance with the Online Store Regulations.
  2. In accordance with Article 23 of the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 883, as amended), data processing is permissible, among others, when:
    • the data subject consents thereto, unless it concerns the deletion of their data.
    • it is necessary for the performance of a contract to which the data subject is a party or when it is necessary to take steps prior to entering into a contract at the request of the data subject.
  3. The processing of personal data by the Administrator always takes place within the grounds for their permissible processing listed in paragraph. 2. Data processing will be related to the performance of a contract or the necessity to take steps prior to entering into a contract at the request of the data subject (paragraph 2, point b). Additionally, before concluding agreements for the provision of electronic services available via the Online Store, the future Service User is informed about the necessity of accepting the Regulations.

IV. RIGHT OF CONTROL, ACCESS TO DATA CONTENT, AND RECTIFICATION

  1. The Service User has the right to access the content of their personal data and to rectify it.
  2. Every person has the right to control the processing of their data contained in the Administrator’s data set, and especially the right to request the completion, update, rectification of personal data, temporary or permanent suspension of their processing, or their deletion, if they are incomplete, outdated, untrue, or were collected in violation of the law, or are no longer necessary for the purpose for which they were collected.

The Administrator applies technical and organizational measures ensuring the protection of processed personal data appropriate to the risks and categories of data covered by protection, and in particular protects data against unauthorized disclosure, unauthorized acquisition, processing in violation of applicable regulations, and alteration, loss, damage, or destruction.
  2. The Service Provider provides the following technical measures to prevent unauthorized persons from acquiring and modifying personal data transmitted electronically:
    • Encryption of data used for Service User authorization.
    • Protection of the data set against unauthorized access.
  3. In matters not regulated by this Privacy Policy, the provisions of the Online Store Regulations and other relevant provisions of Polish law shall apply accordingly.
